Terms of sale
What you are buying when you register a domain or host a website with Havre, and what each side owes the other.
Draft. This document is awaiting owner and legal review. It is published here for review only and is not yet the contract in force.
1. What these terms cover
These terms apply when you register, transfer, renew, or manage a domain name, or purchase managed website hosting, through Havre. They are a contract between you and Havre. Other Havre services have their own terms; where they conflict, the terms specific to the service you are using apply to that service.
You must be able to enter a contract, and the details you give us must be true. Domain registration is not anonymous: the registry that operates your extension requires real contact data and can suspend a name registered with false data.
2. What you are buying
A domain registration is the exclusive right to use a name for a fixed term, granted by the registry that operates the extension, not by Havre. Havre acts as your registrar of record through OpenSRS, operated by Tucows, a Canadian company based in Toronto. We submit your registration, hold the sponsorship, and manage it for you. We do not own the name and neither do we sell it to you outright.
Availability is only certain at the moment the registry accepts the registration. A name can be taken by someone else between your search and your payment. If that happens after we have charged you, you are refunded in full; see the refund policy.
3. Registry rules apply to you too
- For .ca, CIRA requires every registrant to meet the Canadian Presence Requirement. You declare your basis at checkout, and we check it again before we submit the registration. A false declaration can cost you the name.
- For generic extensions (.com, .net, and similar), the ICANN registrar accreditation rules apply, including the requirement that your contact data be accurate and that you respond to the accuracy reminder we are required to send once a year.
- You accept the registrant agreement of the registry for your extension. We pass along any registry policy that binds you, including dispute resolution policies such as the UDRP for generic extensions and CIRA's own policy for .ca.
4. Price, currency, and taxes
Prices are shown in Canadian dollars at checkout and are the amount charged. The price shown at the time of purchase is the price for that term. Renewal is priced at the rate in effect when the renewal happens, which can differ from what you first paid, because registry wholesale prices change. We tell you the renewal amount in the reminders described below before anything is charged.
Applicable Canadian sales taxes are charged where required. Payment is by card through Stripe. Card details go directly to Stripe and never reach a Havre server.
5. When the registration actually happens
Your domain is registered after your payment settles, not before. Usually this takes seconds. If the registry or our registrar back end is unavailable, your order is held and retried automatically, and you are told if it takes longer than expected. Your money is never taken for a name we then fail to deliver: if we cannot complete the registration, the order becomes a refund and you are notified.
An order you start but never pay for expires by itself after 24 hours, and the contact details attached to it are deleted on the schedule in the privacy policy.
6. Renewal, expiry, and reminders
Auto-renew is on by default for a new registration or completed incoming transfer. Before you pay, we show the renewal term, the current renewal price or pricing rule, the planned charge date, and the date by which you can turn it off. Auto-renew is enabled only when you separately authorize Havre to save and charge your payment method for future annual renewals. You can choose off at checkout or turn it off online at any time before the disclosed cutoff, without contacting support or paying a fee. Turning it off does not cancel the term you already bought; the domain remains yours until its displayed expiry date.
We send renewal reminders 30 days and 7 days before a domain expires, whether auto-renew is on or off. Before an automatic charge, the notice states the amount, charge date, payment method, and direct online path to turn auto-renew off. We do not make the first renewal attempt in the same sweep that sends the first advance-charge notice. If a charge fails, we notify you and retry; we do not immediately suspend your site or email.
If a domain expires, the registry decides what happens next, not Havre. Most extensions have a grace period during which the name can be restored, often at a restoration fee set by the registry, followed by a redemption period, after which the name is released to the public. We will tell you what is possible for your specific name, but we cannot override a registry.
7. Transfers
An incoming transfer starts after payment and may require approval by the current domain holder, current registrar, or registry. It is not complete merely because Havre accepted the order. The domain must be unlocked and, where required, you must provide a valid authorization code. Registry rules may prohibit a transfer during a waiting period, including a period after registration or a previous transfer. Transfer fees and whether a transfer adds registration time depend on the extension and are shown before payment; Havre does not promise that every transfer adds one year.
If payment settles but the incoming transfer is declined, times out, or otherwise cannot be completed, we refund the transfer charge in full to the original payment method. After completion, we obtain the authoritative expiry from the registry and place the domain in the renewal lifecycle described above.
Your domain is yours. New registrations are locked against transfer, which is a standard protection against theft of the name. To transfer a domain away from Havre, write to account@havre.cloud from the registrant email address; we unlock the domain and give you the authorization code. Registry rules impose a waiting period after a new registration or a change of registrant, typically 60 days for generic extensions, and we cannot waive it.
8. WHOIS privacy
WHOIS privacy is enabled where the extension allows it. It masks your contact details in the public WHOIS record. It does not hide them from the registry, from Havre, or from a lawful order. For .ca, CIRA masks individual registrants by default but publishes organizations.
9. Cancellation and refunds
A domain registration cannot be cancelled for a refund once it is submitted to the registry, because the registry fee is spent and irreversible. Where a charge succeeded and the registration did not, you are refunded in full and automatically. The full detail, including duplicate charges and renewals, is in the refund policy, which forms part of these terms.
Managed website hosting
Havre website hosting is an annual managed setup and orchestration service using an OVHcloud Web Hosting service in Canada. Havre provides the account workflow, payment, domain attachment, WordPress installation, Havre connector, privacy checks, and provider escalation. OVHcloud operates the underlying shared hosting platform. This is not unlimited WordPress consulting.
You own and are responsible for your content, third-party themes and plugins, custom code, licences, and the people you authorize. Havre does not promise that every WordPress extension will work with Privacy Mode. Privacy Mode intentionally blocks unknown or unapproved external destinations and can therefore stop an integration from working until it is removed or explicitly reviewed.
The label “Hosted in Canada 🍁 Privacy Checked by Havre” is Havre’s technical status, not a government, legal-compliance, or independent certification. It appears only while the latest check verifies the configured Canadian hosting region and finds no blocked or unknown visitor-data destination. Havre withdraws it after a failed or unavailable check and restores it after a later passing check.
Hosting is charged for one year. Auto-renew is enabled only with your separate authorization. You can turn it off online; the paid site remains available until the displayed paid-through date, after which Havre requests termination. Download your content and backups before that date. Refund rights for a hosting failure or cancellation are described in the refund policy and remain subject to applicable consumer law.
Hosting includes automated WordPress, starting-theme, connector, and privacy-check setup. Havre does not edit customer content, apply branding, build pages, migrate an existing site, write custom code, repair third-party themes or plugins, or provide customer-specific integrations. Customers manage their own website content and design through WordPress.
10. Acceptable use
We will suspend or terminate a domain used for phishing, malware distribution, or the sexual exploitation of children, and we will act on a valid legal order. We do not police lawful speech, and we do not read your data to look for reasons to act.
11. What we do not promise
- That any particular name will be available, or will remain available while you decide.
- That a registry will not change its own prices, rules, or policies.
- Uninterrupted availability of the Havre dashboard. The registration itself lives at the registry and does not depend on our dashboard being up.
Except where the law does not allow it to be limited, our liability for any claim relating to a domain is limited to the amount you paid us for that domain in the twelve months before the claim. Nothing in these terms limits the rights you have under the Quebec Consumer Protection Act or other consumer protection law that applies to you.
12. Changes
We can change these terms for future purchases and renewals. Material changes are announced by email to the address on your account before they take effect. The version in force for a purchase is the version published when you made it, and every version carries the date it was last updated.
13. Law and language
These terms are governed by the laws of the Province of Quebec and the laws of Canada applicable in that province, and the courts of Quebec have jurisdiction, without prejudice to any right you have to bring a claim where you live.
